1. Agreement to Terms

By accessing and using 3D AI (the "Service"), you accept and agree to be bound by these Terms of Use and our Privacy Policy and AI Acceptable Use Policy. If you do not agree to these Terms, please do not use the Service.

3D AI has ZERO TOLERANCE for certain types of content.

STRICTLY PROHIBITED CONTENT:

🚫 NSFW & Adult Content

  • Sexually explicit 3D models
  • Pornographic or erotic characters
  • Fetish content
  • Nudity or partial nudity
  • Sexualized depictions of any kind

🚫 Violence & Harm

  • Gore, blood, or graphic violence modeled in 3D
  • Terrorism or extremist props and symbols
  • Self-harm or suicide promotion
  • Illegal acts or dangerous printable items
  • Torture or abuse depictions

🚫 Child Safety (ZERO TOLERANCE)

  • Any 3D content involving minors under 18
  • Child sexual abuse material (CSAM)
  • Sexualization of minors
  • Inappropriate depictions of children
  • Violations will be reported to law enforcement

🚫 Synthetic Likenesses & Misinformation

  • 3D likenesses of real people — character models, busts, or avatars reproducing a real person without explicit consent
  • Image-to-3D on photos of real people without their explicit consent
  • Using real persons' likeness to generate 3D content without explicit consent
  • Political manipulation content
  • Impersonation without consent
  • Election misinformation
  • Counterfeit product models or fraud materials

🛡️ AI CONTENT FILTERING & MODERATION

We employ AI-powered content filtering systems that:

  • Automatically screen all text prompts and uploaded images
  • Block requests that violate our content policies
  • Flag accounts that attempt to circumvent safety measures
  • Report illegal content to appropriate authorities
  • Retain data for security and legal compliance (up to 90 days for activity logs; longer for content saved to a registered user's account)

By using this Service, you agree that your prompts, uploaded images, and generated 3D models may be scanned, filtered, and blocked by our AI moderation systems. Attempts to bypass these systems will result in immediate account termination.

2. Description of Service

3D AI provides AI-powered 3D model generation services that allow users to create real 3D meshes from text descriptions or uploaded images. The Service offers multiple tools:

  • Text-to-3D: Generate 3D meshes from text prompts
  • Image-to-3D: Reconstruct 3D meshes from reference images
  • Tripo 3D: A multi-model flex generator (Tripo, Hunyuan, Meshy) for specialized output characteristics
  • 3D Format Converter: Convert between GLB, OBJ, FBX, STL, and other common 3D formats
  • 3D Model Viewer: Inspect and share 3D models in the browser

The Service is offered with both free and paid tiers. Certain features require account registration and payment.

3. Account Registration and Security

3.1 Account Creation

To access certain features of the Service, you must create an account and provide accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

3.2 Account Eligibility

You must be at least 13 years old to create an account. Users under 18 must have parental or guardian consent to use paid features.

4. Prohibited Uses (IMPORTANT)

You agree to use the Service only for lawful and responsible purposes. The following uses are strictly prohibited:

4.1 Synthetic Likenesses, Image-to-3D on Real People, and Misleading Content

Prohibited: generating 3D character models, busts, or avendars based on a real person's likeness, or using image-to-3D on photos of real people, without explicit consent

  • NO Synthetic Likenesses of Real People: Generating 3D models that reproduce a real person's face, body, or distinctive features without their explicit written consent
  • NO Image-to-3D on Photos of Real People: Uploading any image of a real, identifiable person (celebrity, public figure, or private individual) to produce a 3D model without their explicit written consent
  • NO Impersonation: Creating 3D content that impersonates individuals, public figures, or celebrities without their express consent
  • NO Misinformation: Creating 3D content designed to mislead, deceive, or spread false information — including fake 3D "evidence", forged scans, or fabricated product mockups
  • NO Political Manipulation: Creating 3D content that could influence elections or political processes

4.2 Privacy and Rights Violations

  • NO Unauthorized Use of Likeness: Using photos, scans, or images of individuals without their explicit written consent as input to any 3D generation pipeline
  • NO Harassment: Creating 3D content that harasses, bullies, or targets individuals
  • NO Revenge Content: Creating intimate or private 3D content without consent

4.3 Illegal and Harmful Content

  • NO Illegal Content: Content that violates any applicable law or regulation
  • NO Harmful Content: Content that promotes violence, self-harm, terrorism, or illegal acts
  • NO Child Exploitation: Any 3D content depicting minors in inappropriate situations (zero tolerance)
  • NO Adult Content: Sexually explicit, pornographic, or fetish 3D content
  • NO Hate Speech: Content promoting discrimination, hatred, or violence against groups
  • NO 3D-Printable Prohibited Items: Generating models intended for manufacture where such manufacture is illegal (e.g., firearm parts, counterfeit currency components, circumvention devices)

4.4 Intellectual Property Violations

  • NO Copyright Infringement: Creating 3D models that copy or imitate copyrighted characters, sculptures, or product designs
  • NO Trademark Violations: Using logos, brands, or trademarks without authorization
  • NO Counterfeit Production: Generating models intended to produce physical knockoffs or counterfeits of branded products

4.5 Platform Abuse

  • Attempting to reverse engineer, hack, or exploit the Service
  • Using automated systems to abuse rate limits or access controls
  • Generating content for spam, phishing, or fraud
  • Circumventing our content moderation or safety systems

5. Content Moderation and Enforcement

5.1 Monitoring and Review

We employ various methods to monitor content and enforce these Terms:

  • Automated Systems: AI-powered content analysis and filtering
  • Manual Review: Human review of flagged content when appropriate
  • User Reporting: Mechanisms for users to report policy violations

5.2 Enforcement Actions

We reserve the right to take the following actions for violations of these Terms:

  • Warning: Issuing a warning for first or minor violations
  • Content Removal: Removing or disabling violating content from user accounts
  • Feature Suspension: Restricting access to specific features
  • Account Suspension: Temporarily suspending account access
  • Account Termination: Permanently terminating accounts for serious or repeat violations
  • Legal Action: Referring matters to law enforcement when appropriate

6. Intellectual Property Rights

6.1 Your Content

You retain ownership of text prompts and images you submit. However:

  • You grant us a license to use your prompts and uploaded images for service delivery, content moderation, abuse detection, and service improvement
  • You are responsible for ensuring your inputs comply with these Terms and that you have the rights to upload any reference images
  • Generated 3D models may be used for personal and commercial purposes by account holders in good standing, subject to compliance with these Terms

6.2 Service Content

The Service itself, including its design, code, underlying technology, integrations, and the AI model configurations we operate, is owned by 3D AI and protected by intellectual property laws. You may not copy, modify, or create derivative works based on the Service itself.

6.3 AI-Generated Content Disclaimer

AI-generated 3D meshes may occasionally resemble existing works, products, or individuals. You are solely responsible for ensuring your use of generated content does not infringe on third-party rights, including copyright, trademark, design rights, and rights of publicity. We make no guarantees about uniqueness or originality of any generated model.

6.4 Copyright Infringement

7. Paid Services and Refunds

7.1 Pricing and Payment

Pricing for paid features is displayed on our pricing page. We reserve the right to modify pricing at any time with notice to existing subscribers.

All payments are processed securely through our authorized payment processor. Your payment information is handled securely in compliance with applicable regulations.

8. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Key points include:

  • Guest content is retained briefly for security and abuse detection, then deleted; registered users' generated 3D models are stored in their accounts
  • We implement content moderation to enforce these Terms
  • We may share data with law enforcement when required by law

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • The quality of any 3D meshes generated will meet your expectations or be suitable for any specific purpose (including 3D printing, game production, or engineering use)
  • Any errors in the Service will be corrected
  • Generated content will not infringe on third-party rights

10. Limitation of Liability

To the fullest extent permitted by law, 3D AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us or using account management features. You will remain obligated to pay any accrued fees.

11.2 Termination by Us

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including:

  • Breach of these Terms, especially the Prohibited Uses section
  • Violation of our AI Acceptable Use Policy
  • Suspicious or fraudulent account activity
  • Extended period of account inactivity
  • Discontinuation of the Service or any part thereof

Upon termination, your right to use the Service will immediately cease. Content you have already exported or downloaded is outside our control.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.

13. Indemnification

You agree to indemnify and hold harmless 3D AI from any claims, damages, losses, liabilities, and expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • 3D content you create, export, or distribute using the Service

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by:

  • Updating the "Last Updated" date
  • Sending email notifications to registered users for significant changes

Your continued use of the Service after changes constitutes acceptance of the new Terms.

AI technology carries responsibilities. Please use our Service ethically, legally, and with respect for others. Violations of these Terms, particularly the Prohibited Uses, will result in enforcement action up to and including permanent account termination.
